ESPN, RCR settle lawsuit over Earnhardt No. 3
Richard Childress Racing and ESPN have settled a lawsuit over the use of Dale Earnhardt's No. 3 in a movie the network made about the seven-time champion last year, according to the Greensboro (N.C.) News and Record.RCR filed the suit in federal court last year, and the terms of the settlement are private. "The matter has been resolved to our satisfaction, and the exact terms are confidential," Heather Adams, an attorney for ESPN, told the Winston-Salem Journal. An RCR spokesman also told the newspaper that his company is pleased as well. The suit was over the use of the "stylized No. 3" that Earnhardt used when he drove for Childress. The trademark number appears on souvenirs and memorabilia that are still sold today, nearly five years after his death. ESPN used a different version of the No. 3 for its movie "3: The Dale Earnhardt Story," but RCR called that No. 3 a knokcoff and sued for trademark infringement and unfair competition
